Liability Waiver and Release of Claims

This Liability Waiver and Release of Claims ("Waiver") is entered into by [Participant’s Full Name] ("Participant") and MPower Fitness, located at [Studio Address], in consideration for being permitted to participate in fitness activities and use the Studio’s facilities, including but not limited to Megaformer machines ("Activities").

1. Assumption of Risk

By signing this Waiver, Participant acknowledges and agrees to the following:

  1. Participation in Activities involves inherent risks, including but not limited to physical injury, muscle strain, soreness, sprains, falls, equipment malfunction, or other accidents that may result in serious injury or even death.

  2. Participant voluntarily assumes full responsibility for all risks, known and unknown, associated with participation in Activities, including any risks caused by negligence of the Studio, its employees, trainers, or agents.

2. Waiver of Liability and Release

Participant hereby agrees to:

  1. Waive, release, and discharge the Studio, its owners, employees, trainers, contractors, agents, and affiliates (collectively, "Released Parties") from any and all claims, demands, actions, or causes of action arising out of or related to participation in Activities, including claims arising from the negligence of the Released Parties.

  2. Indemnify and hold harmless the Released Parties from any and all liability, damages, or costs incurred as a result of Participant’s participation in Activities.

3. Fitness and Health Certification

Participant represents and warrants that:

  1. They are in good health and have no medical condition that would prevent safe participation in Activities.

  2. They have consulted with a physician if they have any health concerns or pre-existing conditions that may be affected by physical exercise.

  3. They will inform the Studio of any changes to their health status that may impact their ability to safely participate in Activities.

4. Use of Equipment

Participant agrees to:

  1. Follow all instructions provided by Studio staff and trainers regarding the proper use of Megaformer machines and other equipment.

  2. Refrain from using any equipment they are not trained to use or are uncomfortable using.

  3. Immediately notify Studio staff of any equipment malfunction, hazards, or safety concerns.

5. Photography and Media Release

Participant grants the Studio permission to use photographs, videos, or other media featuring Participant during Activities for promotional, marketing, or educational purposes. Participant may revoke this consent at any time by providing written notice to the Studio.

6. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of the State of [State]. Any disputes arising under this Waiver shall be resolved in the courts located in [County, State].

7. Severability

If any provision of this Waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

8. Acknowledgment and Acceptance

By signing below, Participant affirms that they have read, understand, and voluntarily agree to the terms of this Waiver. Participant acknowledges that they are giving up substantial rights, including the right to sue, and sign this Waiver freely and voluntarily.
